Terms of Service

These Terms set out the conditions and procedures for using the web-based photo booth service provided by PoCut (PoCutFree, the "Service"), and the rights and obligations between users and the operator of the Service.

1. "Service" means all features provided in a web browser, including photo capture, editing, compositing, saving and sharing.
2. "User" means anyone who accesses the Service, agrees to these Terms and uses the Service. The Service has no sign-up process, and you are deemed to have agreed to these Terms at the moment you use the Service.
3. "Output" means content such as images that a User creates by capturing and editing through the Service.

1. These Terms take effect from the moment a User accesses and begins to use the Service.
2. The operator may amend the Terms within the bounds of applicable law and will give advance notice of any amendment on this page.
3. Users who do not agree to the amended Terms may stop using the Service.

The Service provides the following features.

1. Camera capture (countdown burst shooting, aspect ratio selection, mirroring, screen light)
2. Editing (filters, face-detection auto retouch, frame color, layout, caption and date)
3. Saving output (download), copying to clipboard, system share
4. Sending feedback
5. Any other features the operator may add

Some screens of the Service may contain affiliate links (such as Coupang Partners). If a User purchases a product through such a link, the operator may receive a commission from the affiliate program. Screens containing affiliate links display a notice to that effect.

1. The operator may change or suspend all or part of the Service as operational or technical needs require.
2. Advance notice will be given of any suspension where possible.
3. The Service is provided free of charge, and the operator bears no obligation to compensate for changes to or suspension of a free service.

Users must not do any of the following.

1. Capture, edit or use, without authorization, content that infringes another person’s portrait rights, copyright, trademark or privacy
2. Create or distribute content prohibited by applicable law, such as obscene, violent or hateful material
3. Interfere with the normal operation of the Service or generate abnormal requests by automated means
4. Copy or redistribute the Service’s code without authorization to operate an identical or similar service
5. Use the Service for unlawful purposes

1. Captured photos and output being edited are processed only in the User’s web browser memory and are discarded the moment the User leaves or reloads the page. The operator has no obligation to recover them.
2. Output files saved by the User exist only on the User’s device, and the User is responsible for storing, backing up and managing them.
3. The User alone is responsible for saving and sharing output and for all consequences arising from it.

1. Intellectual property rights in the Service’s assets, including its UI, code, design, logo and frame templates, belong to the operator.
2. Copyright in photos captured and output created by the User belongs to the User, and the Service claims no rights over such output.
3. Users may not copy, distribute or commercially exploit the Service’s assets without the operator’s prior permission.

1. The operator is not liable for damage caused by events beyond its reasonable control, such as natural disasters, force majeure, defects in the User’s device or browser, or network failures.
2. The Service operates on in-browser processing, and the User is responsible for the loss of any unsaved output.
3. Some features, such as camera and sharing, may not work properly depending on the User’s device and browser environment, and the operator is not liable for damage resulting from this.
4. The Service is provided "AS IS" without warranty of fitness for a particular purpose or freedom from errors.
5. The operator is not liable for disputes or damage arising from the content of output the User creates with the Service or from its use.

1. The interpretation of these Terms and any disputes are governed by the laws of the Republic of Korea.
2. Any dispute relating to use of the Service shall be brought before the court having jurisdiction under the Civil Procedure Act of Korea.
